The concept of \u201cMiranda Rights\u201d does not exist in Canada.<\/strong><\/p>\n

However, individuals in Canada have certain rights and protections when being arrested or detained by law enforcement officials. These rights are outlined in the Canadian Charter of Rights and Freedoms<\/em><\/a>, which is part of the Constitution<\/em><\/a> of Canada.<\/p>\n

When a person is arrested or detained in Canada, that are entitled to the following rights:<\/strong><\/p>\n

  2. The right to retain and instruct legal counsel without delay and to be informed of this right;<\/li>\n
  3. The right to remain silent when questioned by the police; and<\/li>\n
  4. The right to be told about the availability of duty counsel and legal aid.<\/li>\n<\/ol>\n<\/div>
