As this is by the law of nations, piracy is defined through the body of laws and treaties agreed upon and subscribed to by United Nations member states, who abide by the law of nations. Thus, this section applies to Canadian citizens who commit piracy even outside of Canadian jurisdiction,\u00a0 anywhere in the world.<\/p>\n<p>Piracy is an <a href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/acts\/C-46\/page-7.html\">indictable <\/a><a href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/acts\/C-46\/page-7.html\">offence<\/a> in Canada as indicated in section 74(2) of the <em>Criminal Code<\/em>. These are the most serious types of offences, and can therefore result in severe penalties, such as longer maximum jail sentences and higher fees. Indictable offences generally give the accused the right to choose their type of trial: judge-alone or a jury trial, though there are certain exceptions, listed out in section 553 of the <em>Criminal Code, <\/em>and included within those, is the act of piracy. Thus, an accused charged with piracy does not have the right to choose their mode of trial as piracy is an exclusive jurisdiction offence.<\/p>\n<h3><strong>Examples<\/strong><\/h3>\n<p><strong>Some examples of an act of piracy charge may include the following: <\/strong><\/p>\n<ul>\n<li><a href=\"https:\/\/www.strategiccriminaldefence.com\/faq\/hijacking-charges-canada\/\">Hijacking of vessels<\/a><\/li>\n<li>Kidnapping and\/or detention of persons on a boat<\/li>\n<li><a href=\"https:\/\/www.strategiccriminaldefence.com\/faq\/theft-charges-canada\/\">Theft of cargo and\/or property<\/a><\/li>\n<\/ul>\n<h3><strong>Defences<\/strong><\/h3>\n<p>The defences available to a charge of piracy are entirely dependent on the facts of your case.<\/p>\n<p><strong>However, some defences to a piracy charge may include: <\/strong><\/p>\n<ul>\n<li>Factual innocence<\/li>\n<li>Mistaken identity<\/li>\n<li>Duress<\/li>\n<\/ul>\n<h3><strong>Punishment<\/strong><\/h3>\n<p><strong>A piracy charge is an indictable offence, which entails a maximum punishment as follows:<\/strong><\/p>\n<ul>\n<li>Imprisonment for life.<\/li>\n<\/ul>\n<p>As piracy is an indictable offence and as dictated by section 74(2) and section 745(d) of the <em>Criminal Code<\/em>, it carries an imprisonment for life sentence. There are no mandatory minimum penalties for the offence of piracy, although the individual charged with piracy is eligible for parole after a certain amount of time passes. As this is an imprisonment for life sentence, even in the case of parole, the offender would remain supervised by the Correctional Service of Canada. Moreover, a charge of piracy would affect employment opportunities, immigration status and more.<\/p>\n<\/div><div class=\"fusion-text fusion-text-2\"><h2>Overview of the Offence<strong>\u00a0<\/strong><\/h2>\n<p><strong>According to s. 74 of the <em>Criminal Code: <\/em><\/strong><\/p>\n<\/div><div class=\"fusion-builder-row fusion-builder-row-inner fusion-row fusion-flex-align-items-flex-start\" style=\"width:calc( 100% + 50px ) !important;max-width:calc( 100% + 50px ) !important;margin-left: calc(-50px \/ 2 );margin-right: calc(-50px \/ 2 );\"><div class=\"fusion-layout-column fusion_builder_column_inner fusion-builder-nested-column-0 fusion_builder_column_inner_1_1 1_1 fusion-flex-column cases grey-box\"><div class=\"fusion-column-wrapper fusion-flex-justify-content-flex-start fusion-content-layout-column\" style=\"background-position:left top;background-repeat:no-repeat;-webkit-background-size:cover;-moz-background-size:cover;-o-background-size:cover;background-size:cover;background-color:#f9f9f9;padding: 40px 50px 40px 50px;\"><div class=\"fusion-text fusion-text-3\" style=\"font-size:18px;line-height:1.6;letter-spacing:-0.3px;\"><p><strong>Piracy by law of nations<\/strong><\/p>\n<p>74 (1) Every one commits piracy who does any act that, by the law of nations, is piracy.<\/p>\n<p><strong>Punishment<\/strong><\/p>\n<p>74 (2) Every one who commits piracy while in or out of Canada is guilty of an indictable offence and liable to imprisonment for life.<\/p>\n<\/div><\/div><style type=\"text\/css\">.fusion-body .fusion-builder-nested-column-0{width:100% !important;margin-top : 0px;margin-bottom : 40px;}.fusion-builder-nested-column-0 > .fusion-column-wrapper {padding-top : 40px !important;padding-right : 50px !important;margin-right : 25px;padding-bottom : 40px !important;padding-left : 50px !important;margin-left : 25px;}@media only screen and (max-width:1024px) {.fusion-body .fusion-builder-nested-column-0{width:100% !important;order : 0;}.fusion-builder-nested-column-0 > .fusion-column-wrapper {margin-right : 25px;margin-left : 25px;}}@media only screen and (max-width:640px) {.fusion-body .fusion-builder-nested-column-0{width:100% !important;order : 0;}.fusion-builder-nested-column-0 > .fusion-column-wrapper {margin-right : 25px;margin-left : 25px;}}<\/style><\/div><\/div><div class=\"fusion-text fusion-text-4\"><h3><strong>The Guilty Act (Actus Reus) <\/strong><\/h3>\n<p><strong>The <\/strong><strong><em>actus reus<\/em><\/strong><strong> for a piracy charge under section 74 is established by proof, beyond a reasonable doubt, of:<\/strong><\/p>\n<p><strong>Piracy by law of nations (s. 74(1))<\/strong><\/p>\n<ul>\n<li>The accused committed an act considered piracy by the law of nations.<\/li>\n<\/ul>\n<p>The <em>actus reus <\/em>refers to the act or omission itself that constitutes the physical elements of a crime. Thus, the physical aspect of piracy would be constituted by any physical act or omission of an act of piracy. To take one example, in the case of a hijacking, the pure act of hijacking the vessel, would be considered the <em>actus reus.<\/em><\/p>\n<h3><strong>The Guilty Mind (Mens Rea)<\/strong><\/h3>\n<p><strong>The <em>mens rea<\/em> for a piracy charge under s. 74(1) includes proof, beyond a reasonable doubt, that:<\/strong><\/p>\n<ul>\n<li>The accused knowingly committed an act of piracy;<\/li>\n<li>The accused had no excuse by law to commit an act of piracy.<\/li>\n<\/ul>\n<p><em>Mens rea <\/em>is defined as the knowledge or intention of committing the crime. In the same example of a hijacking, the intention to hijack, or knowledge that one is hijacking a vessel, constitutes mens rea.<\/p>\n<\/div><div class=\"fusion-text fusion-text-5\"><h2><strong>Defences<\/strong><\/h2>\n<h3><strong>How to Beat a Piracy Charge<\/strong><\/h3>\n<p>As in every other case and all other charges, possible defences depend on the facts of your case. The circumstances of each case as well as the evidence available dictate the strength of each available defence. However, listed below are some common defences that may help fight a piracy charge.<\/p>\n<h3><strong>Factual innocence<\/strong><\/h3>\n<p>Factual innocence is a possible defence against piracy. If you can prove, using the evidence and the facts of your case, that you were not engaged in an act of piracy, or, that the evidence does not show that you were engaged in an act of piracy, then you may be able to defend yourself by stating you were factually innocent.<\/p>\n<h3><strong>Duress<\/strong><\/h3>\n<p>Another possible defence to a piracy charge is duress. Duress is proven when the five criteria listed below are met.<\/p>\n<ul>\n<li>That there was a threat of present\/future death or physical harm,<\/li>\n<li>That the accused reasonably believes that the threat would be carried out,<\/li>\n<li>That the accused had no safe way to avoid the harm,<\/li>\n<li>That it is because of the threat, that the accused did what they did, and<\/li>\n<li>That the harm that the accused caused was not disproportionate to the harm that was threatened against the accused.<\/li>\n<\/ul>\n<p>All five elements must be met for the defence of duress to be applicable. There is some debate as to how applicable the defence of duress is to the charge of piracy. In the Charter of Rights, section 17 explicitly notes that piracy is one of the offences excluded from the usage of the defence of duress. Duress therefore is inapplicable to a charge of piracy under this section. However, common law, such as <a href=\"http:\/\/www.apple.com\">R v Ruzic<\/a> and <a href=\"https:\/\/www.canlii.org\/en\/ca\/scc\/doc\/2013\/2013scc3\/2013scc3.html?searchUrlHash=AAAAAQAIciB2IHJ5YW4AAAAAAQ&amp;resultIndex=1\">R v Ryan<\/a> notes that the list of excluded offences under section 17 is unconstitutional as that risks convicting morally innocent individuals. Section 17 is still valid, and as such it is generally up to the discretion of the judge on whether the defence of duress is applicable or not.<\/p>\n<h3><strong>Identity<\/strong><\/h3>\n<p>There may be a possible identity defence to a piracy charge. For this defence to be raised successfully, the accused would have to prove that they did not commit piracy.<\/p>\n<\/div><div class=\"fusion-text fusion-text-6\"><h2><strong>Punishments<\/strong><\/h2>\n<p>The <em>Criminal Code<\/em> provides for a possible maximum life imprisonment sentence if convicted of a piracy charge. A <a href=\"https:\/\/www.canlii.org\/en\/ca\/scc\/doc\/1995\/1995canlii47\/1995canlii47.html\">life imprisonment sentence<\/a> is the most severe punishment that can be laid upon offenders, and as such, it is only dealt out to the most severe of crimes.
