It is separated into two offences based on the cost of alleged damage: over $5,000 and under $5,000. Mischief can be committed in several ways, from the destruction of property to the obstruction of its lawful use.<\/p>\n<p><strong>The provision for mischief in the <em><a href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/acts\/c-46\/page-91.html#docCont\">Criminal Code of Canada<\/a><\/em> is:<\/strong><\/p>\n<\/div><div class=\"fusion-builder-row fusion-builder-row-inner fusion-row fusion-flex-align-items-flex-start\" style=\"width:calc( 100% + 50px ) !important;max-width:calc( 100% + 50px ) !important;margin-left: calc(-50px \/ 2 );margin-right: calc(-50px \/ 2 );\"><div class=\"fusion-layout-column fusion_builder_column_inner fusion-builder-nested-column-0 fusion_builder_column_inner_1_1 1_1 fusion-flex-column cases grey-box\"><div class=\"fusion-column-wrapper fusion-flex-justify-content-flex-start fusion-content-layout-column\" style=\"background-position:left top;background-repeat:no-repeat;-webkit-background-size:cover;-moz-background-size:cover;-o-background-size:cover;background-size:cover;background-color:#f9f9f9;padding: 40px 50px 40px 50px;\"><div class=\"fusion-text fusion-text-2\" style=\"font-size:18px;line-height:1.6;letter-spacing:-0.3px;\"><p><strong>Mischief<\/strong><\/p>\n<p><strong>430 (1)<\/strong> Every one commits mischief who wilfully<\/p>\n<p><strong>(a)<\/strong> destroys or damages property;<\/p>\n<p><strong>(b)<\/strong> renders property dangerous, useless, inoperative or ineffective;<\/p>\n<p><strong>(c)<\/strong> obstructs, interrupts or interferes with the lawful use, enjoyment or operation of property; or<\/p>\n<p><strong>(d)<\/strong> obstructs, interrupts or interferes with any person in the lawful use, enjoyment or operation of property.<\/p>\n<\/div><\/div><style type=\"text\/css\">.fusion-body .fusion-builder-nested-column-0{width:100% !important;margin-top : 0px;margin-bottom : 40px;}.fusion-builder-nested-column-0 > .fusion-column-wrapper {padding-top : 40px !important;padding-right : 50px !important;margin-right : 25px;padding-bottom : 40px !important;padding-left : 50px !important;margin-left : 25px;}@media only screen and (max-width:1024px) {.fusion-body .fusion-builder-nested-column-0{width:100% !important;order : 0;}.fusion-builder-nested-column-0 > .fusion-column-wrapper {margin-right : 25px;margin-left : 25px;}}@media only screen and (max-width:640px) {.fusion-body .fusion-builder-nested-column-0{width:100% !important;order : 0;}.fusion-builder-nested-column-0 > .fusion-column-wrapper {margin-right : 25px;margin-left : 25px;}}<\/style><\/div><\/div><div class=\"fusion-text fusion-text-3\"><p>These four methods of committing mischief are quite broad.<\/p>\n<p><strong>The most common types of mischief include damage to property, such as:<\/strong><\/p>\n<ul>\n<li>Spray painting a building,<\/li>\n<li>Slashing someone\u2019s tires, and<\/li>\n<li>Smashing someone\u2019s window.<\/li>\n<\/ul>\n<p>However, mischief can also include things like pulling a fire alarm, playing loud music late at night, or refusing to leave someone\u2019s property.<\/p>\n<p>In certain circumstances, mischief may be considered more serious, having more significant penalties. For example, mischief relating to a place of worship, educational institution, daycare, community centre, seniors\u2019 residence, war memorial, or cultural property can result in greater punishment. Additionally, the <a href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/acts\/c-46\/page-89.html#h-122977\">Criminal Code<\/a> makes specific mention of mischief in relation to computer data and testamentary instruments which come with higher penalties. Finally, mischief that causes actual danger to life may result in life imprisonment.<\/p>\n<p><strong>Punishment for mischief is generally divided into two categories:<\/strong><\/p>\n<ol>\n<li>The property is valued at more than $5,000<\/li>\n<li>The property is valued at less than $5,000<\/li>\n<\/ol>\n<p><strong>When addressing mischief by way of damage to property, the Crown Prosecutor will be required to prove beyond a reasonable doubt that:<\/strong><\/p>\n<ul>\n<li>Property was damaged,<\/li>\n<li>The damage was caused by you,<\/li>\n<li>You did not own the damaged property,<\/li>\n<li>You did so wilfully, and<\/li>\n<li>The approximate value of the property.<\/li>\n<\/ul>\n<p>Many people will insist that they did not \u2018intentionally\u2019 damage property or \u2018intentionally\u2019 interfere with its enjoyment. However, the Court need only be convinced that an accused did so \u2018recklessly.\u2019 If the Court determines that you were careless while being conscious of a risk or danger, they will deem the actions \u2018wilful\u2019. For example, if a person held a loud party that went late into the night, the Court may find they were aware of the risk of interfering with their neighbour\u2019s enjoyment and find that person guilty.<\/p>\n<h2>Investigation of Mischief Charges in Victoria<\/h2>\n<p>An investigation of an alleged mischief charge in Victoria is typically initiated by the alleged victim (or relative or witness). They contact the Victoria, Saanich, or Oak Bay Police Service and report it. The police will request a written or videotaped statement from the complainant and any witnesses and will initiate an investigation.<\/p>\n<p>Victoria area Police take property crimes very seriously and mischief is no exception. The police will typically engage in a thorough investigation to find sufficient evidence to charge. This may include interviewing all witnesses, reviewing any video surveillance, seizing any evidence involved, photographing the scene, and obtaining receipts for damaged property.<\/p>\n<p>After the police have gathered their evidence, they will arrest you if they believe you are the perpetrator. If you are not present at the scene, police will track you down or issue a warrant for your arrest.<\/p>\n<p>After you have been charged, police will provide a package with all the evidence they collected, known as the \u201cdisclosure package,\u201d to the Crown Prosecutor. You will have the right to access this disclosure package to see the evidence against you. Once you retain one of our lawyers, we will assist you in obtaining the disclosure package, and we will review it with you to assess the strengths and weaknesses of the Crown\u2019s case, as well as any legal defences that may be available to you.<\/p>\n<h2>Penalties for Mischief Charges in Victoria<\/h2>\n<p>In cases of simple mischief charges, the likelihood of going to jail if convicted is relatively low.<\/p>\n<p><strong>However, the risk of jail time increases dramatically where:<\/strong><\/p>\n<ul>\n<li>The mischief was directed at specified locations, such as a place of worship, educational institution, war memorial, or community centre;<\/li>\n<li>It involved a specific type of property such as computer data or testamentary instrument;<\/li>\n<li>It caused actual danger to life;<\/li>\n<li>It was a \u201chate crime;\u201d<\/li>\n<li>The value of damage is over $5,000; or<\/li>\n<li>There are prior convictions.<\/li>\n<\/ul>\n<p>If any of these factors are present in your case, the Crown will almost always seek a jail sentence.<\/p>\n<p>Because the penalty for mischief depends on the value of the property, there is a wide array of potential sentences if you are found guilty. The penalties can range anywhere from a discharge (i.e. a finding of guilt, but no criminal conviction), to a fine and\/or probation, to a period of jail time. Often, good representation can result in no criminal record. This could include:\n<ul>\n<li><strong>No mental intent: <\/strong>A common defence available in mischief cases is that you did not <em>intend <\/em>to damage or interfere with the property. A basic example would be if you accidently spilled paint on a neighbour\u2019s driveway.<\/li>\n<li><strong>You owned the property:<\/strong> If the property is legally yours, you cannot be convicted of damaging or interfering with it, unless you were engaging in fraud. Therefore, if you are able to establish that you had a proprietary or possessory interest in the property, you may be able to defend yourself against the charges. Documents proving ownership of the property will likely be of significant assistance in raising this defence.<\/li>\n<li><strong>Identity:<\/strong> In some circumstances where the offence was not recorded by surveillance footage, or the footage is poor quality, you may be able to raise an identity defence. For example, authorities could have made a mistake in identifying you as the perpetrator based on the poor quality of the footage. In order to effectively raise this defence, you may need corroborative evidence, such as an alibi to where you were at the time of the offence.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Violation of Constitutional Rights<\/strong>: The <a href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/const\/page-15.html\"><em>Canadian Charter of Rights and Freedoms<\/em><\/a> sets out your rights before and after your arrest. If the police fail to abide by these rights, it could aid in your defence.<\/li>\n<li><strong>\u201cColour of Right\u201d:<\/strong> This defence may arise when you honestly believed you had a lawful right to property, when in reality you did not. For example, if you honestly, but mistakenly believed that you purchased a home and began to renovate, even though the sale did not go through. In order to raise this defence, you will need to establish a factual basis to show that you honestly and reasonably believed in this particular state of affairs.<\/li>\n<li><strong>\u201cObtaining or Communicating Information\u201d: <\/strong>This defence may arise when you only interfered with the use or enjoyment of property in order to convey or receive information. For example, a neighbour entering adjacent property to discuss repairs to a shared fence.<\/li>\n<\/ul>\n<p>The Crown is required to prove that you not only damaged or interfered with property that was not lawfully yours, but that you <em>intended <\/em>to do so. While the Crown must prove beyond a reasonable doubt that you committed the offence, you may bear some responsibility in raising certain defences at trial.<\/p>\n<p>The availability and strength of any defence depends entirely on the specific facts of your case. If you are uncertain what information may be relevant, you should contact one of our lawyers immediately to create a plan of action for gathering information.<\/p>\n<p><strong>If you are truly proactive about the matter, consider doing the following:<\/strong><\/p>\n<ul>\n<li>Secure proof of employment;<\/li>\n<li>Secure reference letters;<\/li>\n<li>Enroll in counselling (anger management\/substance abuse\/parenting);<\/li>\n<li>Secure a record of prescriptions; and<\/li>\n<li>Secure a record of any mental health conditions you suffer from.<\/li>\n<\/ul>\n<p>These steps can be very helpful for building an effective defence (or convincing the Prosecutor to drop the charges altogether).<\/p>\n<h3>What can a lawyer do to help me defend against mischief charges in Victoria?<\/h3>\n<p><strong>As we start preparing your defence by examining police actions and the evidence against you, there are certain defence strategies that can be used to aid your cause, including:<\/strong><\/p>\n<ul>\n<li>Assembling documents, photographs, texts, etc. that contradict the allegation and support your defence;<\/li>\n<li>Gathering evidence from witnesses that support your version of events;<\/li>\n<li>Identifying mistakes in the actions of the police, such as Charter breaches;<\/li>\n<li>Uncovering administrative\/systemic errors, such as \u201cJordan delay,\u201d non-disclosure, lost or destroyed evidence, etc.; and<\/li>\n<li>Finding weaknesses or \u201choles\u201d in the Crown\u2019s case that may make it difficult or Impossible for them to establish the elements of the offence.<\/li>\n<\/ul>\n<h2>Further Reading<\/h2>\n<p><strong>\u00a0Below are a few notable cases dealing with various aspects of mischief charges:<\/strong><\/p>\n<p><strong>\u00a0<\/strong>In <a href=\"https:\/\/www.canlii.org\/en\/ab\/abca\/doc\/1991\/1991abca59\/1991abca59.html?autocompleteStr=r%20v%20harding&amp;autocompletePos=18\"><em>R v Harding<\/em>, 1991 ABCA 59<\/a>, a group of people entered a hospital and blocked access into rooms where abortions were being performed. They were charged with mischief due to their actions obstructing the lawful use of the property. The Court determined that the <em>colour of right<\/em> defence requires a legal belief, not a moral one.<\/p>\n<p>In <a href=\"https:\/\/www.canlii.org\/en\/ns\/nsca\/doc\/1993\/1993canlii3233\/1993canlii3233.html?autocompleteStr=r%20v%20surette&amp;autocompletePos=1\"><em>R v Surette,<\/em> (1993) 82 C.C.C. (3d) 36 (NSCA)<\/a>, the accused won a vehicle in a lottery which he registered in his wife\u2019s name. After a marital dispute he wilfully damaged the vehicle and was charged with mischief. The Court determined that due to his honest and reasonable belief that he had total interest in the vehicle, and could therefore damage it if he wished, he was entitled to an acquittal on the grounds of <em>colour of right<\/em>.<\/p>\n<p>In <a href=\"https:\/\/www.canlii.org\/en\/on\/onca\/doc\/1997\/1997canlii1934\/1997canlii1934.html?autocompleteStr=r%20v%20madd&amp;autocompletePos=1\"><em>R v Maddeaux, <\/em>(1997) 6 C.R. (5<sup>th<\/sup>) 176 (ONCA),<\/a> the accused was convicted of mischief for playing loud music, disturbing his upstairs neighbour. In rendering its decision, the Court defined \u201cuse or enjoyment\u201d of an apartment as including cooking, eating, cleaning, resting, sleeping, listening to radio and watching television. \u201cOperation\u201d was considered to normally refer to commercial, institutional, or industrial enterprise. Any wilful interference with one of these activities may result in a mischief conviction.<\/p>\n<p>In <a href=\"https:\/\/www.canlii.org\/en\/on\/oncj\/doc\/2018\/2018oncj231\/2018oncj231.html?autocompleteStr=r%20v%20livingston&amp;autocompletePos=10\"><em>R v Livingston,<\/em> 2018 ONCJ 231<\/a>, the accused, who was the former chief of staff to the Ontario Premier, deceived the authorities and ordered his staff to wipe all sensitive and confidential data from the computers in the Premier\u2019s office. He was then charged with mischief involving computer data.
