How can I get my driving while disqualified charges dropped?
In some cases, there is a possibility that after reviewing all of the evidence against you, we find weaknesses that are detrimental enough to the Crown prosecutor’s case that we can persuade them to drop the charges against you. If this does not happen, there are other ways that you can ensure that you are not convicted of this offence without proceeding to trial.
For example, we can engage in early case resolution negotiations with the Crown, and we may be able to persuade them to drop your criminal charges in exchange for a timely guilty plea to a traffic offence. As a result, you will likely pay a fine, but will ultimately be able to completely avoid a criminal conviction. If your charges are too serious or if the evidence against you is too strong to persuade the Crown to allow you to plea to a traffic offence, there are some sentencing options that can significantly reduce the penalty that you face after a finding of guilt. For example, we can make an in-court application on your behalf for a conditional discharge. A conditional discharge is not the same as a conviction. Instead of being convicted after a finding of guilt, you will be ‘discharged’ from the offence if you comply with certain conditions for a specified amount of time. In order to learn more about discharges, please visit our FAQ on conditional and absolute discharges.
If this is not your first offence and a discharge is not appropriate in your circumstances, we can work to secure a sentence that will place minimal restrictions on your liberty. For example, we can advocate for you to avoid any time spent in prison and instead have you pay a fine, or a fine or probation. If prison is unavoidable, we can also advocate for sentences that will allow you to serve your sentence in the community with a conditional sentence order, or for you to serve an intermittent sentence and only serve weekends in jail. No matter what your circumstances may be, contact one of our criminal defence lawyers immediately and we will immediately begin working to secure the best possible outcome for your charges.
